01/08/15 – Reminder on Bylaw Ineligibility from Last Date of Varsity Participation

With the beginning of the second semester, we wanted to remind you again about the change within Bylaw 6 dealing with the period of ineligibility (for those students subject to the provisions of Bylaw 6) that went into effect on August 1, 2014.

Previously, the rule stated that the period of ineligibility following a transfer was one year from the date of enrollment in the new school. Following the change, the Bylaw now states that a student-athlete who is subject to the transfer rule is ineligible for one year from the date of his/her last participation at the previous school.

It is possible due to this change, that there are student-athletes who were previously thought to be ineligible (due to the former one calendar year from enrollment provision) that would now be eligible sooner due to their date of last varsity participation. That reduced ineligibility period would reflect the change in the Bylaw and should be calculated from the last date of varsity participation at the sending school.

For example:  A student was ruled ineligible in the 2013-14 school year on April 15, 2014. The one calendar year period from enrollment into the new school would previously have expired on April 15, 2015. The student’s last varsity participation at the sending school was January, 30, 2014. Under this scenario due to the bylaw revision the student would become eligible January 30, 2015 as this is one year from the last date of varsity participation.

There is no form or information to be submitted to our office or additional ruling necessary once the one year period since the last varsity participation has expired.

If you have general questions about the transfer rule and its provisions, contact the Commissioner. If you have specific questions that deal with records of specific students, please contact Assistant Commissioner Darren Bilberry (dbilberry@khsaa.org) if the receiving school is in basketball Regions 1-8, or Associate Commissioner Butch Cope (bcope@khsaa.org) if your school is in basketball Regions 9-16.
